Sorry to hear the bad news..... but don't loose heart.

I think Raffi gave you many good reasons for you to appeal, and hopefully you can find the information about the COA...... to prove your innocent and put the ball on the UKBA court.

What I do not understand is why the Irish need 18 months to issue you a Passport?

Bloody ridiculous in my opinion.

OK I am going to look around and see if I can find something to help.

John,
Contact details for the British Embassy in Baku, Azerbaijan.
Visa Section Web page Note that the web page says that the visa section will be closed after 1pm on the 23rd of September so if it was me I would call the Embassy and enquire (in a business like and polite way) who you would have to contact concerning a query with an existing visa no need to mention the fact that it is to do with a rejected visa at this stage. Contact Details, Visa Section (Baku)

Local time in Baku

I hope that you manage to get through and that you get an answer concerning who you need to contact next.
I suspect that it might be the British Embassy in Ankara contact details but please hang fire until this is confirmed.

Take a look at these links...

Can you come to the UK as a family visitor?

http://www.ukba.homeoffice.gov.uk/visas ... uirements/

You must also be able to show that:

  • you are 18 or over;
  • you intend to visit the UK for no more than 6 months (or 12 months if you will be accompanying an academic visitor);
  • you intend to leave the UK at the end of your visit;
  • you have enough money to support and accommodate yourself without working or help from public funds, or you and any dependants will be supported and accommodated by relatives or friends;
  • you can meet the cost of the return or onward journey; and
  • you are not in transit to a country outside the 'Common Travel Area' (Ireland, the UK, the Isle of Man and the Channel Islands).

and also

Abolition of the Certificate of Approval scheme

http://www.ukba.homeoffice.gov.uk/sitec ... ion-of-coa

Personaly I agree with what Farri said.

I do not think that your wife broke any rules and you had permission to get married.

it is their fault..... that gave you permission.

Good luck

Thanks for the reply guys and positive words.

Yeah - I am angry because I feel we are being judged incorrectly by someone who does not even know us. It is almost like a feeling of victimisation. But don't worry, I am calm :P

My friend (who, I must admit, I don't talk to as much anymore but do on occasion) of mine's mother is Beverley Hughes, the old Labour immigration minister. Maybe I should have a word. Although I do know she resigned in a scandal. Anyway, I've just sent him a message on facebook to see if she could help, or be willing to help in anyway.

Also, local MP is looking at our application on a whole, with the supporting documents and the refusal decision letter to see if she thinks it is fair or not.

Raffi, woldl this email to ECM consitue a formal appeal...

Or do we have to complete the IAFT-2 form it says on the decision letter? I have printed one of these out as Alisa would not be able to complete herself.

I am in the process of writing the email/letter and I am remaining calm :)

Got it is annoying. What threat is she to warrant non issue of a visa ? It's hard to satisfy these guys.

Wiz - that is the visa we did apply for and they denied :)

John,
My opinion.
Don't muddy the waters. Too many cooks spoil the broth.
Try and deal with this yourself, it is OK to receive advise but if too many individuals get involved then the issues will get confused + the ECO / ECM will play the participants against each other.

Please note My opinion.

If It was me I would not go for the formal appeal (at least not yet) I would ask them to reconsider the decision taking into account the extra information that you have provided.

I will try to reply later in more detail, I have to go, work is calling :(

Hi guys,

Received a telephone call from Kate Green (Labour MP for my local constituency). She has reviewed my case and she is going to write a letter to the Minister of Sate (Damian Green minister of immigration) tomorrow to ask him to review the decision.

I will get a copy of her letter tomorrow which I am looking forward to seeing. I’m not too sure what she will write and she advised it will be around 4-5 weeks to receive a reply.

What do you think the outcome could be?

Is this something positive to look upon?

John,
In my experience nobody has ever had a result from MP intervention, that does not mean to say that it is not possible.

I do hope that it works out and with your luck it probably will.
So far you seem to have come up lucky with almost everything.
  • Meeting your wife on Facebook = Luck factor 10/10
  • Applying for and getting a COA at (what seems to be the perfect moment in time) = Luck factor 10/10
  • Being able to claim dual nationality (Irish) = Luck factor 10/10

I hope that I will be able to add
  • Getting a result from an MP intervention

If it was me I would not rest on my laurels, I would still complete all my preparations to deal with the issue myself, but then that is me.

Hi there,

I am no expert in these matters but i was floicking through the BBC news website and came across this story about a Supreme Court judgement, and reminded me of your post about your own situation.

www.bbc.co.uk/news/uk-15272121

The court has ruled that the ban on non-EU foreign spouses under the age of 21 is unlawful, and in breach of Article 8 of the European Convention on Human Rights - namely a right to a family and private life.

The government has to either scrap the legislation or amend it so that it complies with Article 8. As i have said, I am no expert on these things but maybe this opens up an alternative route and possibly the best option in the long term, that of the spouse visa?

Anyway whatever the situation currently, best of luck.
